Permission-Based Email Policy

SndControl is a software service provided by Emoto Corp., an Oklahoma corporation d/b/a SndControl™ and its affiliates (hereinafter referred to as “we”, “us”, or “SndControl”), and by purchasing and using SndControl and/or its website http://sndcontrol.com with its associated subdomains (collectively the “SndControl Services”), you are considered an End User (“you”, “user”, “End User”, or “customer”) that agrees to the terms of this Permission-Based Email Policy (this “policy”). This policy, along with SndControl’s Terms & Conditions (found at http://sndcontrol.com/terms), will help you understand why we will contact you via email, how we will do it, and what choices you have. Your feedback is important to us because we take notice, choice, consent, and privacy very seriously and need to hear your concerns so we can respond. We welcome your questions and comments on this policy at compliance@sndcontrol.com.

  1. Why are you receiving emails from SndControl?

    You have either: (i) entered into a transaction with SndControl and are receiving emails to facilitate, complete, or confirm such transaction or, at regular periodic intervals related to your transaction with SndControl, you are receiving your relevant account balance information such as any change in your standing or status with SndControl; (ii) submitted your email to us confirming by written authorization to receiving more information about SndControl including product tutorials, newsletters, and other marketing materials; (iii) submitted your email to SndControl to accept delivery of a promotional offer and related marketing content from SndControl; or (iv) you have created an account and/or subscribed to SndControl and are an End User of SndControl Services with an ongoing relationship involving the ongoing use by you of products or services offered by SndControl, including the electronic delivery of SndControl Services updates or upgrades that you may be entitled to receive based on your subscription under SndControl’s Terms & Conditions. SndControl uses a confirmed opt-in policy to ensure, by you submitting your email to us, that you intended to join your mailing list. You become active when you click on the confirmation link. This policy guards against the possibility that a third-party could add you to SndControl’s email list without your knowledge or permission.

  2. What is SndControl’s Permission-Based Email Policy?

    Permission-based email refers to email messages sent only to persons who requested them, in contrast to unsolicited email messages which are generally prohibited by the CAN-SPAN Rule (See 16 C.F.R. § 316 et seq. found at http://www.ecfr.gov/cgi-bin/text-idx?SID=44f685e2875e9aeb47558958f9ccbfbc&mc=true&node=pt16.1.316&rgn=div5). You can grant or deny specific permission to receive emails from SndControl, or you can have an existing customer relationship with SndControl that implies you want to receive email messages relevant to such customer relationship. We require that you agree to receive our email communications either directly by opting in indicating your understanding of this policy and submitting your email, or by you indicating your acceptance of an ongoing customer relationship with the SndControl in which you affirmatively provide your email to us indicating your consent to receive emails from SndControl.

  3. Can you subscribe to our mailing lists without having an ongoing customer relationship with SndControl?

    Visitors to SndControl’s website that have not installed or downloaded SndControlService can use the form available on SndControl’s website to opt-in and subscribe to SndControl’s mailing list; however, as a visitor, you will be limited to the specific mailing list upon which you subscribed, which may not contain all our marketing and/or promotional offers.

  4. Why have I received emails from SndControl since I don’t remember signing up for any SndControl mailing list?

    We only want to send you information and promotional offers via email message if you want to receive them. Unfortunately, other marketers try to work around these rules and send emails to recipients that either did not ask to receive the messages, or that they do not know who the sender is. That’s not us. We gain no advantage by annoying people with unwanted emails. If you think we have sent you an email by mistake or you wish to unsubscribe from SndControl’s mailing list, please opt-out by clicking the unsubscribe link in the last email sent to you from us. To ensure that you are removed expeditiously from SndControl’s mailing list, please forward/reply the email you received from us to compliance@sndcontrol.com and type “THERE HAS BEEN A MISTAKE. PLEASE UNSUBSCRIBE _______________(insert email address) FROM YOUR EMAIL LIST”. We will remove your email as soon as possible but, in any event, if you notify us by email, we guarantee that you will be removed from all SndControl mailing lists containing any commercial advertisement or promotion of a commercial product or service in ten (10) days or less.

  5. What if you subscribed to SndControl’s mailing list but you have not received any emails from SndControl?

    If we detect an invalid email address or bounce back emails from an email address you submitted to SndControl, you will not be added to SndControl’s mailing list and you may have your account with SndControl terminated, including any SndControl Services associated with that email address. If we have sent you a confirmation email, but you have not verified your account and/or email address, we will only send you a maximum of two follow-up confirmation emails before removing you from SndControl’s mailing list, and without you confirming your email address, you may have your account with SndControl terminated, including any SndControl Services associated with that email address. If you are having difficulty confirming your account and/or email address with SndControl or believe you have made a mistake by submitting the wrong email address, etc., please email support@sndcontrol.com and type “THERE HAS BEEN A MISTAKE. I CANNOT CONFIRM MY ACCOUNT. PLEASE ADD ______________________(type correct email) TO YOUR EMAIL LIST. _________________________(type first and last name).” We will follow-up with you accordingly to resolve the issue.

YOU ARE IN CONTROL OF OUR EMAIL RELATIONSHIP WITH US AND, UNDER ANY CIRCUMSTANCES, THE EASIEST WAY TO OPT-OUT OF RECEIVING ANY FURTHER EMAILS FROM US IS TO SEND A SINGLE REPLY EMAIL TO US AT COMPLIANCE@SNDCONTROL.COM TELLING US YOUR ELECTRONIC EMAIL ADDRESS AND OPT-OUT PREFERENCES.
